The eIDAS Regulation distinguishes between a simple electronic signature (SES), an advanced electronic signature (AES), and a qualified electronic signature (QES). The QES is the most secure option because it links the signature to a personal certificate.

Qualified Electronic Signature (QES)

The Qualified Electronic Signature can be used for virtually all types of contracts, such as employment contracts, notices of termination, and standard contract forms used in everyday business. According to Article 25(2) of eIDAS, the QES has the same legal validity as a handwritten signature and can therefore also satisfy the written form requirement.

Simple Electronic Signature (SES)

The Simple Electronic Signature is the simplest form of electronic signature, which does not need to meet any specific technical requirements. It includes any type of digital mark that confirms a person’s identity, such as a scanned name, a checkmark in a digital document, or clicking an “Agree” button.

SES differs from advanced and qualified electronic signatures in that it does not require additional authentication or encryption and is therefore less secure.
